Hi,
Here is the last Mock Trial question. (Don't forget to state your name)
How does a witness answer a question, when the answer is not supplied in his/her statement? Are there any exceptions?
Give an example of a question and answer which would not conflict with the witness's statement, and not materially affect his/her testimony or the trial. Give an example of a question and answer which would either conflict his/her testimony or materially affect his/her testimony or the trial.
Have a great rest of the week! See you all tommorow (or Monday)!
Taylor Govi. Is the example in the rule section of Impeachment.
ReplyDeleteYou cover any conflict in the closing statement.
I found the answer to this in the objections section. The example you would make up on your own from the witness statement.
ReplyDeleteFor example-
1st Example (Doesn't cause conflict)-
Question: Where were your kids on the night of Dec. 18, 1988, Mrs. Barrett?
Answer: Catherine was at a sleepover and Todd was at colledge (it doesn't give this answer in her statement, but her statement does say no one else was home that night except for Lee, so we can assume the kids were somewhere else)
2nd Example (Has affect on the case, and we can't do this)-
Question (adressed to C.M. Chaney): Did you find any evidence of a motive that Mrs. Barrett could have for killing her husband?
Answer:Yes, I found a email from her to John Barrett saying that she would kill him because he was cheating on her.
But, you don't have to give an example. I just relized how hard it was to do, when I actually tried. You could just answer the question if you want.
